 Terms and conditions for submitting photographs to The Grahamstown Project

 

  1. By submitting your photographs you agree to grant The Grahamstown Project, a perpetual, royalty-free, non-exclusive, sub-licenseable right and license to use, reproduce, modify, adapt, publish, create derivative works from, distribute, make available to the public, and exercise all copyright and publicity rights with respect to your photograph worldwide and/or to incorporate your photograph in other works and publications in any media now known or later developed for the full term of any rights that may exist in your photograph. If you do not want to grant to The Grahamstown Project the rights set out above, please do not submit your photograph to The Grahamstown Project.

1.2 It’s important to note, however, that you still own the copyright to everything you contribute to The Grahamstown Project and that if your image is accepted, we will endeavour to publish your name alongside it wherever used. The Grahamstown Project cannot guarantee that all pictures will be used and we reserve the right to edit your comments.

1.3 Should your photograph be sold to a third party, the Grahamstown Project will endeavor to negotiate a fair price for your picture – the proceeds of which will be split between The Grahamstown Project and the photographer.

  1. Further to paragraph 1 above, by submitting your photograph to The Grahamstown Project you:

2.1 warrant that your photograph is your own original work and that you have the right to make it available to The Grahamstown Project for all the purposes specified above;

2.2 warrant that your photograph does not infringe any law.

2.3 agree to indemnify The Grahamstown Project against all legal fees, damages and other expenses that may be incurred by The Grahamstown Project as a result of your breach of the above warranties; and

2.4 agree to waive any moral rights in your photographs for the purposes of its submission to and publication on The Grahamstown Project and for the purposes specified above.

  1. These terms and conditions will be governed by the laws of South Africa and the parties agree to submit to the exclusive jurisdiction of the South African Courts.
